• Terms and Conditions for VISIT BUSAN PASS

    Aritcle 1 Purpose

    These terms of use (Terms) shall specify the rights, obligations and responsibilities between the user and the Korea Tour Pass (Company) in relation to the use of the Busan Tour Pass (Pass) issued by the Company as well as basic matters, such as the methods and procedures for using the Pass.

    Article 2 Terminology

    Terminology for these Terms shall be as follows.
    1. Company refers to a virtual business place that has been commissioned by the Busan Tourism Organization to provide goods and services (hereinafter referred to as “goods, etc.”) to users so that goods and services can be traded using information and communication facilities such as computers. It is also used in the sense of a business operator operating an Internet site.
    2. Pass refers to both a Card Pass and a Mobile Pass that provides users with free or discounted benefits at attractions in partnership with the Company.
    3. User refers to both members and non-members as tourists who agree to these Terms for the Pass, and purchase and use the Pass in a legitimate way.
    4. Member refers to a person who is registered as a member on the official website and mobile app of the Pass.
    5. Affiliated facilities refers to cultural, tourism, shopping and other tourism-related facilities that entered into a partnership agreement with the Company.
    6. Use time refers to the time during which the user is allowed to visit tourist attractions with the Pass. The use time is calculated from the moment when the first tourist attraction is visited in counts of 24 hours and 48 hours
    7. The number of times of use refers to the number of times a user visits a tourist attraction with a pass. Passes that restrict the number of visits to paid facilities are divided into 3 and 5 times passes.
    8. Valid period refers to the period during which the user is allowed to enter attractions after purchasing the Pass, and it includes the extinctive prescription for commercial claims. The exact duration of the valid period can be checked via the official website.

    Article 3 Efficacy and Changes

    1. These Terms shall apply to all users who wish to use the Pass. However, in the case of the Pass purchased from affiliated official distributors other than the official website or mobile app of the Pass (Official Website, Etc.) or offline distributors designated by the Company, the terms and conditions of the applicable distributors shall be applied.
    2. The Company may change these Terms within the scope of not violating related laws. If the Company changes the Terms, the effective date and the reason for the change shall be specified and notified via channels, such as the official website, ten (10) days prior to the applicable effective date. However, if the Terms are changed unfavorably to the user, the changes shall be indicated in an easy-to-understand manner for the user and notified thirty (30) days before the effective date.

    Article 4 Membership

    Those who wish to become a member of the Official Website, Etc. shall apply for membership by expressing one's intention to agree to these Terms after filling in the required information according to the form set by the Company.

    The Company shall register a person who applies for membership pursuant to paragraph 1 as a member, unless he or she falls under any of the following items:

    1. If the applicant for membership has previously lost his or her membership due to the reasons attributable to him or her, except when he or she has obtained approval from the Company for re-registration as a member;
    2. If an applicant uses other people's personal information;
    3. If a child under the age of 14 has not obtained the consent of a legal representative (e.g. parent);
    4. If any false information is provided, or information requested by the Company is not provided;
    5. If the application is made for an improper use or for the purpose of pursuing profit;
    6. If the application is made for the purpose of breaching the relevant laws and violating social order or morals;
    7. If it is confirmed that it is an illegal or unfair application for membership, or the Company cannot register an applicant as a member for the reasons attributable to him or her.

    Members' personal data shall be managed according to the privacy policy of the Company.

    Article 5 Special Rules for Membership of Minors Under 14

    1. A person under the age of 14 shall fully understand the purpose of collection and use of personal data, and obtain the consent of a legal representative (e.g. parent) before applying for membership and providing his or her personal information.
    2. The Company shall cancel or not allow any person under the age of 14 who has not undergone a procedure of receiving the consent of a legal representative (e.g. parent).
    3. A legal representative (e.g. parent) of a member under the age of 14, may request to view, correct, delete and stop processing the personal data of children, and request to withdraw the consent to collect such information or withdraw the consent to membership. In this case, the Company will take the necessary action immediately.

    Article 6 Membership Termination and Disqualification

    1. A member may request to terminate his or her membership at any time through the membership termination procedure on the Official Website, Etc., Contact via Email or Live Chat provided by the customer center, or other ways provided by the Company. We will then process your withdrawal. In this case, the Company will implement a membership termination procedure immediately.
    2. If a member falls under Article 5(2), the Company may limit or suspend the membership.

    Article 7 Change of Member Information

    1. If the information entered by the member at the time of the membership registration is changed, the information shall be corrected without delay. The members shall be responsible for all liabilities arising from not changing the information.

    Article 8 Notification and Information Provision to Members

    1. In the case of a notification to members, it can be made via email, SMS/MMS or notices posted on the Official Website, Etc.
    2. In the case of a notification to all members or a large number of unspecified members, the notification under paragraph 1 can be replaced by posting the notices. However, an individual notification shall be made for matters that have a significant impact on the transaction of the member.
    3. The Company may post various information related to the Pass on the screen of the Official Website, Etc. or provide it to the member through the processes described in paragraph 1.

    Article 9 Management of Dormant Members

    1. In order to protect the member's personal data, the Company may put the account of a member who has not accessed the Official Website, Etc. for more than one (1) year into a dormant state.
    2. The members who have been put into the dormant state may undo the dormant state through a separate identity verification process on the Official Website, Etc.

    Article 10 Responsibility of Email Address and Password Management)

    1. Members shall thoroughly manage their email addresses and passwords, and shall be responsible for any consequence arising from their negligence or illegal use. The Comapny shall be responsible for the issues caused by malfunctions in the system, such as the Official Website, Etc.
    2. Members shall not allow third parties to use their email address and password. If a member discovers that his or her email address and password have been stolen or have been used by a third party, he or she shall notify the Company immediately and follow the instructions provided by the Company, if any.

    Article 11 Issuance of Pass

    The Company shall notify the following matters in relation to the issuance of the Pass via the official website, etc.

    1. Issuer
    2. Conditions of use
    3. Valid period
    4. Available attractions
    5. Refund conditions and method
    6. Matters concerning payment guarantee or the signing of a damage compensation insurance contract
    7. Contact information of the person in charge of handling damages and disputes for the user

    If a physical Pass is damaged due to the user's negligence, it will not be reissued.

    Article 12 Purchase of Pass

    1. The Pass may be purchased separately as a physical pass and a mobile pass as follows.
    1) Physical Pass : This Pass refers to a pass that can be purchased by selecting the pick-up date and location on the Official Website, Etc. and then exchanging the voucher issued after the purchase for the Pass to be used at a pick-up location designated by the Company. A physical Pass may also be purchased from offline distributors designated by the Company.
    2) Mobile Pass : This Pass refers to a pass that uses the QR code that is displayed on the Company's mobile app at the same time when the purchase is made on the Official Website, Etc.
    2. In order to purchase the Pass via the Company's Official Website, Etc., a purchaser shall become a member in accordance with Article 4.
    3. If the member has a discount coupon, it may be used by entering the coupon number at the stage of payment for the Pass.
    4. For a physical Pass, the member shall possess the voucher sent to the member's email address at the time of purchase or the issued voucher on the mobile app, if the Pass is purchased thereon, and visit the pick-up location selected by the member on the reserved date to receive the Pass.

    Article 13 Valid Period of Pass

    1. All passes are valid from the date of purchase and are valid for up to 180 days from the date of purchase.

    Article 14 Use of Pass

    1. The Pass can be used within the valid period for the following hours of use or for as many attractions as indicated.
    1) Period Pass: Used for 24 hours, 48 hours from the time of first admission to an attraction.
    2) Attraction Pass: Used for up to the indicated number of attractions.
    2. Users may use the Pass for the valid period specified in paragraph 1 or as many times as the indicated number of attractions, and cannot use the Pass if either the valid period or the indicated number of attractions is exceeded.
    3. The valid period for discount attractions is the same as for free attractions, and details regarding the use of the Pass, such as at free attractions, discount attractions, and as a transportation card, will be announced on the official website and mobile app.
    4. Pass with a damaged, copied, or forged QR code is rendered invalid and the user is held responsible.
    5. Information pertaining to the Pass or use at attractions is subject to change without notice, and in the event of changes, the information will be posted on the official website.
    6. Pass is transferable to another person, in which case the Company holds no responsibility for loss or damage. The same goes for a Card Pass that is registered on the mobile app.

    Article 15 Purchase cancellation and Refund

    1. Customers who have purchased a Pass can request a refund or cancellation of their subscription as outlined below.
    1) You may cancel the payment for your Card Pass purchased from the official website or mobile app that you have not picked up within 180 days of the payment date.
    2) You may cancel the payment within 180 days of the payment date by making your intention known to cancel the Pass at the Busan Station Tourist Information Center if you have picked up your Card Pass described in the preceding paragraph. In this case, however, the box with the Pass shall be presented together with the purchase receipt in an unopened state.
    3) You must follow the refund policy of the online retailer affiliated with the Company to process the refund of the Card Pass you have not picked up.
    4) You may request a refund at pickup location within 180 days of the payment date if you purchase and pick up your Card Pass from an online retailer affiliated with the Company. In this case, however, the box with the Pass shall be presented together with the purchase receipt in an unopened state.
    5) You may cancel or receive a refund for your Card Pass purchased from an offline retailer designated by the Company within 180 days of the purchase date by returning the box containing the Pass to the corresponding retailer in an unopened state.
    6) You can cancel your Mobile Pass within 180 days from the date of purchase from the official website, etc. If the Mobile Pass was purchased from another point of purchase, the refund will be processed according to the retailer's refund policy. In this case, you may only cancel the payment at the point of purchase if the VISIT BUSAN PASS is still valid and you have not registered to use the official app.

    2. In the following situations, you cannot request a withdrawal or refund for your Pass.
    1) If you lose your Card Pass
    2) If you have registered the Card Pass in the mobile app
    3) If the transportation card (LOCA Mobility, etc.) function of the Card Pass has been used
    4) If applicable to any other conditions provided on the website, etc.
    3. Charging, using, and refunding the functions of the transportation card (LOCA Mobility, etc.) included in the Card Pass are subject to the refund policy of the transportation card issuing institution.

    Article 16 Protection and Use of Personal Data

    1. The Company shall strive to comply with the relevant laws, such as the Personal Information Protection Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., and make efforts to protect the personal data of members.
    2. The specific details regarding how the personal data of members is processed shall be described in the privacy policy posted on the Company's Official Website, Etc. The Company shall obtain the consent of the members for the collection of personal data, etc. when there is an application for membership and process his or her information accordingly.
    3. If personal data is exposed due to reasons attributable to the member, the Company shall not be held responsible unless there is a reason attributable to the Company.

    Article 17 Attribution of Rights

    1. Intellectual property rights such as trademark rights, design rights, and copyrights for posts and passes posted on the company's official website belong to the company.
    2. By purchasing a pass, the purchaser does not have the rights under paragraph 1 and can only use it for personal use within the scope permitted by the company.
    3. Users may not copy or distribute reproductions of trademarks, designs, etc. related to posts and passes pursuant to Paragraph 1, except when the company explicitly permits it.

    Article 18 Payment Guarantee

    The company does not subscribe to a separate payment guarantee or damage guarantee insurance.

    Article 19 Compensation

    1. In the occurrence of damage to the user due to the intention or negligence of the Company, the Company shall compensate only for the actual damage.
    2. The Company shall not compensate the user for any damage caused by any of the following reasons, unless there is a reason attributable to the Company:
    1) When the transaction is not completed normally by using the Pass in a way other than the information provided by the Company to the user;
    2) When purchasing or using the Pass illegally or fraudulently;
    3) When the Pass is deformed or used by destroying its original shape;
    4) When the Pass is stolen or lost;
    5) When damages are incurred while performing general tourism activities or using the affiliated facilities;
    6) When the Pass is used in an unusual way other than the method provided by the Company.
    3. In the event that the Company receives various objections, including claims for damages or lawsuits, from third parties due to any illegal act performed by the user while using the Pass or any conduct in violation of these Terms, the user shall indemnify the Company at his or her own responsibility and expense. If the Company is not indemnified, the user shall compensate the Company for all damages caused thereby.

    Article 20 Disclaimer

    1. The Company shall not be held responsible for any other disputes in relation to the use, etc. of the Passes purchased on the Company's Official Website, Etc. or from a distributor other than those designated by the Company (including an affiliated official distributor).
    2. The Company shall not be held responsible if the user is unable to use the Pass due to natural disasters or force majeure equivalent thereto.
    3. The Company shall not be held responsible for any transaction, etc. caused by the user and third parties through the Pass, unless there is a reason attributable to the Company.
    4. The Company shall not be held liable for any damage caused by a failure of a communication service that is outside of the control area of the Company and other similar causes, unless there is a reason attributable to the Company.
    5. The Company is not responsible for any damage caused by viruses, spyware and other malicious programs that are illegally transmitted or distributed by third parties, directly or indirectly, the Company's Official Website, Etc., or transmitted or distributed by others unless there is a reason attributable to the Company.
    6. The Company is not responsible for the reliability and accuracy of various information, data, and facts posted by users on the company.
    7. The Company shall not be held liable in the occurrence of a problem in the use of the affiliated facilities due to a cause attributable to the affiliated facilities or force majeure equivalent to a natural disaster, or in the occurrence of damage to the user in the process of using the affiliated facilities, unless there is a reason attributable to the Company. In this case, the user needs to check matters related to affiliated facilities (e.g. hours, availability) in advance.

    Article 21 Governing Law and Dispute Resolution

    In the occurrence of any dispute over or interpretation of matters not specified in these Terms, the decision shall be made upon agreement between the user and the Company. However, if an agreement cannot be reached, the relevant laws and commercial practices, such as the Act on the Regulation of Terms and Conditions, and the Act on the Consumer Protection in Electronic Commerce, Etc., and other laws of the Republic of Korea.

    Disputes related to the Pass and these Terms shall be resolved through a lawsuit with the Busan District Court as the competent court of the first instance.
